Terms of Service
1. The agreement
These terms are between you and Elsinore Advisors LLC, doing business as Elsinore Ventures ("Rooted", "we", "us"). By creating an account or using Rooted, you agree to them. If you use Rooted for a company, you confirm you may agree on its behalf.
2. What Rooted does
Rooted audits your website and connected marketing tools, explains what it finds, offers fixes, and drafts marketing content. A fix changes your tools only after you press approve. Findings and drafts can be wrong; review them before you rely on them.
3. Your account
Keep your sign-in secure. You are responsible for what happens in your workspace, including what members you invite do.
4. Connecting your tools
When you connect a tool, you let Rooted access it within the permissions you grant, to provide the features you use. Connect only tools you are allowed to connect. You can disconnect at any time. Each tool's own terms still apply to your use of it.
5. Prices and payment
Audits are free. Fixes and other deliverables are paid; the price is shown before you approve. Payments are processed by Stripe. If a fix or deliverable you paid for fails or is not delivered, we return its credits. Credits you have bought and not used are refunded on request within 30 days of purchase. Credits spent on delivered work are not refunded, except where the law requires.
6. Acceptable use
Do not use Rooted to break the law, to send spam or messages people did not agree to receive, to access systems you are not allowed to access, or to interfere with Rooted or other users.
7. Data Rooted adds to your tools
When you approve it, Rooted fills in job titles and profile links for people in your CRM, using People Data Labs. You may use that data only for your own business. You may not use it, or let anyone use it: to decide whether a person gets credit, insurance, a job or promotion, housing or a tenancy, or a government license or benefit, or for any other purpose covered by the Fair Credit Reporting Act; for debt collection or background checks; to re-identify data that was made anonymous; to train generative AI models; for anything illegal, fraudulent or abusive, or that data protection law forbids; to promote weapons, adult content, credit repair, payday loans, tobacco, marijuana, counterfeit goods or particular stock purchases; for one political candidate, party or campaign; for an intelligence agency; or as evidence in law enforcement. You may not resell it, give others bulk access to it, or build a product that competes with People Data Labs.
8. Your content
You keep ownership of your data and content. You let us use it only to provide and improve Rooted for you, as described in our Privacy Policy. Content Rooted drafts for you is yours once you approve it.
9. Our service
Rooted, its software and its brand belong to us. Do not copy, resell or reverse-engineer it.
10. No warranty
Rooted is provided "as is". We do not promise it will be error-free or that any result, such as traffic or leads, will follow.
11. Limit of liability
To the extent the law allows, we are not liable for indirect or lost-profit damages, and our total liability is limited to the greater of the fees you paid us in the 12 months before the claim and $100.
12. Ending
You can stop using Rooted and close your account at any time. We may suspend or end access if these terms are broken.
13. Changes and law
We may update these terms; we will post the new version here with a new date and email account owners about important changes. These terms are governed by the laws of the State of New York, and disputes go to the state and federal courts in New York County, New York.
